Prof. Tom ZWART from the Cross Cultural Human Rights Centre at Vrije
Universiteit Amsterdam, through the 2021 Honours Programme for VU, UvA and AUC

The goal of Lecture Three is to introduce to you how the
present State governance framework and legal system have evolved as what they
are today. The two leading topics are:

the rise and fall of the USSR governance model (the 1930s to 70s);
-
the building of the law-based governance model (80s to now).
In
specific, we will look into:

The politicalisation of the judiciary between 1940s and 1970s: what is
the social and political contexts for accepting and applying the doctrine of
mass line?

The legal renaissance from the 1980s to now: what are major legislative
and implementation reforms following the end of the Cultural Revolution?
·
The juridification from the 1980s to now: what are the motives of the
top decision-makers to establish the basic governance norms via legislation and
expand the power realm of law in State governance?
